What MedSpot is
MedSpot is software for medical practices: an electronic medical record with charting, protocols, physician oversight and delegation, pharmacy ordering, scheduling, billing, inventory and patient CRM. Our customers are clinics and licensed physicians, who subscribe to MedSpot to run their own practices.
MedSpot is not a healthcare provider and does not sell medical services to patients. Care decisions, prescriptions, orders and treatment outcomes are the responsibility of the clinic and the licensed clinicians who use the software. MedSpot does not provide medical advice and is not party to the clinician/patient relationship.
Accounts and users
Accounts are created for a clinic or practice. The person who creates the account confirms they are authorized to bind that organization to these terms. Physicians complete NPI and state license verification before clinical features are enabled. The clinic invites its staff, assigns each person a role, and is responsible for the activity of everyone it gives access to — keep credentials secure and remove access promptly when someone leaves.
Customer responsibilities
As a customer you agree to (a) hold and maintain the licenses required for the care you provide, (b) operate within the scope of those licenses, (c) configure roles, delegation and co-signature rules appropriately for your practice and jurisdiction, and (d) obtain any patient consents and give any notices the law requires for the information you record in MedSpot. You remain responsible for the accuracy of your clinical records.
Pharmacy ordering
Pharmacy ordering is opt-in for each physician and requires an acknowledgement before first use. Orders are placed with independent partner pharmacies, which are responsible for filling, compounding, pricing and shipping. MedSpot transmits the order and shows its status; it does not dispense medication.
Patient data
The clinic owns the patient information it records in MedSpot. MedSpot processes that information on the clinic's behalf as a Business Associate under HIPAA, under a Business Associate Agreement with the clinic. See our HIPAA page for the safeguards we apply.
Subscription and fees
Subscription fees, billing cycle and any add-ons are set out in your plan or order at signup. Fees are billed in advance and are non-refundable except where the law requires otherwise. You can cancel at any time, effective at the end of the current billing period, and export your data before your account closes.
AI features
AI features are optional and switched on by the clinic. Anything AI drafts or suggests is a starting point for a clinician to review; the clinician is responsible for what they sign.
Acceptable use
Don't use MedSpot to scrape, reverse-engineer, or interfere with the service; impersonate other people; or upload content you don't have rights to. We reserve the right to remove content and suspend accounts that violate these rules.
Disclaimers
The service is provided "as is." To the maximum extent permitted by law, MedSpot disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms limits liability for fraud, gross negligence, or anything else that cannot be limited by law.
Disputes
Any dispute arising out of or related to these terms will be resolved by binding arbitration on an individual basis (no class actions). The seat of arbitration and governing law are specified in the addendum delivered at signup. You may opt out of arbitration within 30 days of accepting these terms by emailing [email protected].
Changes
We may update these terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
